These Terms and Conditions of Sale apply when you buy products directly from www.barbarianbarware.co.uk (the “Website”). Please read them carefully before placing an order.
1. Who we are
The seller is ACANTHA GROUP LIMITED, trading as Barbarian Barware, a company registered in England and Wales under company number 12712056. Our registered office is Knolls Lodge, Plantation Road, Leighton Buzzard, United Kingdom, LU7 3JB. You can contact us at sales@barbarianbarware.co.uk.
In these terms, “we”, “us” and “our” means ACANTHA GROUP LIMITED trading as Barbarian Barware. “You” means the person buying products from us.
2. These terms and your order
These terms, our Returns Policy, Privacy Policy and any product-specific information displayed on the Website form the contract between you and us for your order. Please check that all order details are correct before submitting it.
Submitting an order is an offer to buy the products. Our automated order acknowledgement confirms that we have received your order; it does not accept it. A contract is formed only when we dispatch the products, or when we otherwise expressly confirm acceptance. We may decline an order before acceptance, for example where a product is unavailable, a price or product description is incorrect, payment cannot be authorised, or we reasonably suspect fraud.
3. Products and descriptions
We aim to describe and photograph products accurately. Colours, finishes and appearance may vary slightly depending on your device and the nature of the materials. Product images are illustrative unless we state otherwise. Any dimensions, weights and capacities are approximate unless expressly stated to be exact.
Products are supplied for normal domestic and personal use unless we agree otherwise in writing. They are not intended for resale, commercial hire or any purpose for which they are not designed. Please follow any care, safety and use instructions supplied with the product.
4. Availability
Products are subject to availability. If we cannot supply an ordered product after accepting your order, we will tell you as soon as reasonably possible and refund amounts paid for that unavailable product.
5. Price and payment
Prices are shown in the currency displayed on the Website and include VAT where applicable, unless clearly stated otherwise. Delivery charges, if any, are shown before you place your order. We take reasonable care to ensure prices are accurate, but if an obvious pricing error affects your order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order.
Payment must be made using the payment methods shown at checkout. You confirm that you are authorised to use the selected payment method. We do not normally store full payment-card details; payments are handled by our payment-service providers.
6. Delivery
Delivery options, charges and estimated delivery times are shown at checkout. We will deliver without undue delay and, unless we agree a different period with you, within 30 days after the contract is formed. Delivery times are estimates, not guarantees, unless we expressly agree a specific date.
The products are your responsibility from the time they are delivered to the address you provide or collected by you. Ownership passes to you when we have received payment in full. Please inspect your order promptly and contact us if goods are damaged, incomplete or incorrect.
7. International delivery
If we offer delivery outside the UK, you are responsible for checking that the products can be lawfully imported into the destination country. Unless we state otherwise at checkout, you are responsible for customs duties, import taxes, clearance charges and any other charges applied at the destination. Your statutory consumer rights may vary according to the country in which you live.
8. Cancellation, returns and refunds
UK consumers buying online usually have a legal right to cancel an order within 14 days after delivery, subject to statutory exceptions. We also offer an additional 30-day goodwill returns policy for most unused products. Nothing in these terms affects your legal rights. In particular, products must be of satisfactory quality, fit for purpose and as described.
9. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for business losses where you buy as a consumer, or for loss caused by your misuse of a product or failure to follow its instructions.
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
10. Personal data
We use personal data in accordance with our Privacy Policy. Our Cookie Policy explains how the Website uses cookies and similar technologies.
11. Other important terms
We may transfer our rights and obligations under these terms to another organisation, but this will not affect your rights. You may only transfer your rights or obligations if we agree in writing, except where the law permits otherwise. If a court finds part of these terms unlawful or unenforceable, the rest will remain in effect.
These terms are governed by the law of England and Wales. If you are a consumer living outside England and Wales, you may also have the protection of mandatory laws in your country of residence. You may bring proceedings in the courts that have jurisdiction under applicable consumer law.
